Contemporary Canadian Business Law Essay A minor named Alice entered into a contract with Silver Flatware Ltd. for purchasing silverware on a long-term credit contract. The goods was delivered but the payment was not yet been fully made by Alice. Before she attain the age of majority, Alice repudiated the contract and refused to return the silverware. The company demanded a return of the silverware and refused to refund. The company sued Alice for the balance of purchase price. The legal issues in this case are whether Alice has the legal capacity to the contract and whether Alice has the right to repudiate the contract. If the second question is answered affirmative, what the effect of repudiation will occur in this case? Should Alice return the silverware and should she be liable to the lost of teaspoons? Finally, should the Silver Flatware Ltd. Refund the money had been paid by Alice? The plaintiff’s argument would be that the defendant must return the goods if she wants to repudiate the contract. The lost of teaspoons should be counted as damage to the goods and the plaintiff is entitled to recover the loss by charging compensation from the defendant. The defendant’s argument would be that she has the right to repudiate the contract since she was a minor while entering into the contract and she repudiated the contract before her attaining of the age of majority. The defendant has the option to repudiate the contract because the contract has not been fully performed and it was signed for purchasing non-necessary goods. The defendant was entitled to a return of the payment as she was a minor at the time she entered into the contract. The defendant was not liable to the lost of teaspoons since it was not a direct result of the minor’s deliberate act and it was not recoverable by the merchant. In my opinion, the probable decision of the court would be that the defendant must return the goods and the plaintiff must refund all the monies paid by the defendant. The defendant must return the goods before the plaintiff is obliged to return the monies paid. The defendant is not liable to the lost parts of the goods. The reasons for the probable decisions are as follows. Firstly, public policy dictates that minors should not be bound by their promises. The defendant did not have the legal capacity to a contract since she entered into the contract and repudiated the contract before her attaining of the age of majority. Secondly, the contract has not been fully performed as the defendant has not made full payment of the goods, so the contract is voidable at the defendant’s option. Thirdly, the goods purchased was a non-necessary goods since the silverwork is commonly considered as luxury but not necessary. Therefore, the plaintiff is not liable on such contract. According to the reasons stated above, the defendant who is a minor has the right to repudiate the contract at any time and at her option, for the reason of the contract has not been fully performed and it was for purchasing non-necessary goods. Additionally, once the contract has been repudiated, the minor is entitled to a return of any deposit paid to the adult contractor. Since the minor has purchased the goods on credit and taken delivery, the minor must return the goods before the merchant is obliged to return any monies paid. Finally, the loss of loosing teaspoons is not recoverable by the merchant because there is no evidence provided to proof that the loss is a direct result of the minor’s deliberate act.

Dating back to the 18th century concretions have been known as geologic curiosity’s due to the various sizes, shapes and compositions. Concretions have also been thought to be dinosaur eggs, extra-terrestrial debris, human artifacts and animal and plant fossils. Due to these curiosity’s I will try and enlighten you more on these in the following by explaining the process in which they are formed and explaining some locations where they can be found in large outcrops. â€Å"The word "concretion" is derived from the Latin "con"-- meaning "together" -- and "cresco" -- meaning "to grow."† Concretions are hard compact accumulations of mineral matter and are found inside sedimentary rocks. Some examples of this are Sandstone and in some weathered volcanic rock. Concretions come in many different shapes and the most common of the shapes is spherical or disk shaped. Concretions are the most varied-shaped rocks of the sedimentary world. The way concretions come to be is the mineral matter concentrates around the nucleus of a host rock. The nucleus is often organic such as a tooth or leaf or shell or fossil. As the mineral matter concentrates around the nucleus it forms harder zones known as nodules. Concretions are very odd in the sense that they very in size, shape, color and hardness. Often concretions are mistaken for bones, fossils, meteorites and other odd objects. They can be so small that it requires a magnifying glass to be visible or as large as 10 feet in diameter and weigh hundreds of pounds. Concretions can also have somewhat of regular shapes such as boxes, blocks, flat disks, pipes, cannon balls and have even been known to resemble parts of a human body such as a foot or ribs. Concretions are most commonly composed of calcite but sometimes can be composed of iron oxide or iron hydroxide such as goethite. But also concretions can be composed of other minerals ranging from siderite, ankerite, dolomite, pyrite, baryite and gypsum. Concretions form in many different ways. The box shape of some ironstone concretions most often depend on the way a sandstone or shale bed breaks up due to the action of weathering into regular blocks of various sizes. The way in which this separation takes place along natural planes of weakness in a rock such as a horizontal bedding surface and vertical joints. Before this process of separation, as well as during the separation ground water soaks into the rock and circulates through the planes of weakness making the rock more porous.

Blind cane Our s-cane will have several unique features that will outstand and give our product a chance to compete with the other existence cane out there in the market. 2. 3. 1 Unique features * Build in Global Positioning System (GPS) that will help in navigating the blind person to the place that he or she wishes to go to. * Earphone provided to aid the blind person in hearing commands given to them by the s-cane. * Build in ultrasonic sensor that will help in identifying obstacles ahead to prevent the blind person from hitting or misjudge the path that they are walking into. Retractable front end tip of the cane that will help the blind person in keeping their s-cane safe in their bag or even their pocket. * The s-cane also has a build in radio that can provide some entertainment to the blind person. At the moment there are no smart cane on the market yet, but there are several researches and also some prototype that has been developed by other countries on this smart cane. 2. 6 Opportunities for the expansion of the product.There will be some possibilities that this s-cane will be expanding on the market and will probably receive a high in demand on the market especially when we were able to market this product at a reasonable and affordable price. We are hoping that our product can be used widely by the blind person all over the world and will have a positive impact on the daily life of a blind person. Although it is a new product but, the function and also the unique features embedded in the s-cane will contributes a lot in aiding the blind person’s daily routine in either going to work, walking down the street or even walking their children to school.To increase the chances of having a higher opportunities in expanding this product, we were also thinking of collaborating with other big company out there such as Samsung, LG, Philips ad much more. This will help a lot to our product in expanding its new invention to the people out there that have never heard of it before. People as we know will go for a known brand as compared to those new developed brand out there. So, by collaborating our s-cane product with the company out there we will be able to market the s-cane more widely and much more easily.

But then a minute later she found out that the news she heard about her husband was not true. When she found out her husband was gone she thought she had a life the way she may have wanted. That all changed when she found out about her husband and that he was still alive. Her dreams came to a big halt when she found out that someone might have been gone then turns out they werent. This news came to be the scariest moment in her life. The emotions that Mrs. Mallard had to over come from the death of her husband. Caused her own death instead. Her freedom that she thought she may have had was all token away just like that. Mrs. Mallard could not handle anymore and caused her heart to end. The readers were able to really understand more about the characters in the story. There were many different views have things have went through the story. The person who wrote the story was compassionate and made Mrs. Mallardrs thought seeing to the sensible and more reasonable. There was still something that she might be scared of. But she would keep to herself. Mrs. Mallard felt that reaching out to the sound and the world around her was something she need to do. Mrs. Mallard my have been in one of that dysfunctional marriage.
